Terms of Service
These Terms of Service ("Terms") form a binding agreement between you and Truyou Ltd ("Truyou", "we", "us") when you access or use our application, websites, or related services (the "Service"). By signing up or using the Service, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you don't agree, don't use the Service.
1. Eligibility
You must be at least 16 years old (UK and EU) or 13 years old (United States) to use the Service. If you are under 18, you confirm that a parent or legal guardian has reviewed and approves these Terms on your behalf. You must also have the legal capacity to enter into a contract.
2. Your account
- You are responsible for keeping your password confidential and for all activity under your account.
- You must provide accurate registration information and keep it up to date.
- One person, one account. Don't share your account or impersonate someone else.
- If you suspect unauthorised access, contact [email protected] immediately.
3. Subscriptions and billing
Some features require a paid subscription. Where billing is enabled:
- Prices are shown in the app and may change with at least 30 days' notice for existing subscribers.
- Subscriptions auto-renew until cancelled. You can cancel at any time from Account Settings; cancellation takes effect at the end of the current billing period.
- UK and EU consumers have a 14-day right to withdraw from new subscriptions, unless they expressly request the digital service start within that period and acknowledge that doing so cancels their right of withdrawal.
- Refunds outside the statutory period are at our discretion.
- Taxes (e.g. VAT) are added where applicable.
4. Acceptable use
You agree not to use the Service to:
- Break the law, infringe rights of others, or upload content you don't have the right to upload.
- Post content that is unlawful, defamatory, hateful, harassing, sexually exploitative of minors, or that incites violence.
- Attempt to access another user's account, or to circumvent security, rate limits, or access controls.
- Reverse engineer, scrape, or copy substantial parts of the Service except as permitted by law.
- Send spam, run automated mass-creation of accounts or content, or interfere with normal use of the Service by others.
- Use AI features to generate content that violates the AI provider's policies (e.g. CSAM, malware, weapons design).
We may suspend or terminate accounts that breach these rules, with or without notice depending on severity. We may also remove specific content that breaches them.
5. Your content
You own everything you create in the Service ("Your Content"). You grant Truyou a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, back up, and process Your Content solely for the purpose of operating, improving, and providing the Service to you. This licence ends when you delete Your Content or your account, except for backups (which expire on our retention schedule) and copies that the law requires us to keep.
You confirm that Your Content does not infringe anyone else's rights and that you have permission to upload any third-party material it contains (e.g. photos taken by someone else).
6. AI features
Some features use third-party AI providers (currently OpenAI and Anthropic) to generate text, transcriptions, recipes, narratives, and images at your request. AI output may contain errors or inaccuracies, may be similar to output other users receive, and is not professional advice. You are responsible for reviewing AI output before relying on it. See our Privacy Policy for how content is handled when you use these features.
7. Intellectual property
The Service, including its software, design, and trademarks, is owned by Truyou and its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use it in accordance with these Terms. We reserve all rights not expressly granted.
8. Third-party services
The Service relies on third parties (Google Firebase, OpenAI, Anthropic, Stripe, etc.). We are not responsible for their actions, but we choose them carefully and bind them by contract. If a third party becomes unavailable, we may change providers with notice.
9. Suspension and termination
You can stop using the Service at any time and delete your account from Account Settings → Danger Zone → Delete Account.
We may suspend or terminate your account if:
- You materially breach these Terms.
- We are legally required to.
- Operating the Service for you would create undue risk for Truyou or others.
On termination, your access ends and your content is deleted in line with our retention schedule (see Privacy Policy section 7). Sections of these Terms that by their nature should survive termination (e.g. liability, intellectual property, governing law) will continue to apply.
10. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, Truyou disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI output will be accurate.
Nothing in these Terms excludes or limits liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded under UK law.
11. Limitation of liability
To the fullest extent permitted by law, Truyou's total liability to you for all claims arising from or relating to the Service in any 12-month period is limited to the greater of (a) the amount you paid us for the Service in that period, or (b) GBP 100. We are not liable for indirect, special, incidental, consequential, or punitive damages, or for lost profits, data, or goodwill.
These limits apply only to the extent the law allows. UK and EU consumers retain all rights they cannot waive under consumer protection law.
12. Indemnity
If your use of the Service or breach of these Terms causes a third party to bring a claim against Truyou, you will indemnify and hold us harmless from reasonable costs and damages arising from that claim, except to the extent caused by our negligence or wilful misconduct.
13. Changes to the Service or Terms
We may change the Service or these Terms from time to time. For material changes to the Terms, we will give you reasonable notice (at least 30 days where possible) by email or in-app. If you don't agree, your sole remedy is to stop using the Service before the changes take effect.
14. Governing law and disputes
These Terms are governed by the laws of England and Wales. Disputes will be heard exclusively in the courts of England and Wales, except that consumers may bring claims in their country of residence where required by local law. Where available, you may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
15. Miscellaneous
- If any part of these Terms is unenforceable, the rest remains in effect.
- Our failure to enforce a right is not a waiver of it.
- You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
- These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and Truyou regarding the Service.
